We will endeavour to operate scheduled maintenance during periods where we anticipate low levels of online use. We will also need to be able to do emergency maintenance and/or suspend access to the Service where, in our reasonable discretion, we see the need to do that. We will use reasonable endeavours to have the Service and/or the Website (as applicable) available again as soon as practicable.

4.6. It is your responsibility to pay for all costs and expenses (including, but not limited to, all telephone call or line charges, mobile, data, subscription, or other charges or internet service provider access or subscription charges) that you may incur connecting to the internet in order to use the Website and/or the Service.

5. REGISTRATION, PASSWORDS AND SECURITY

5.1. In order to use the Service via the Website you are required to register a personal account via the Website.

5.2. To register your account you will be required to provide your email address and a password and to enter other information that we may ask for on our registration form such as (but not limited to) your first and last name and billing information (Registration). You should ensure that the password you choose is unique to your use of the Service and not the same password that you use for other services. Your personal information will be processed in accordance with our Privacy Policy.

5.3. We reserve the right to refuse to allow any user to register for the Service for any reason.

5.4. When we accept your registration, we will send an email confirming your registration and the details of the applicable membership. For a subscription purchased for your own use, access will normally begin when that confirmation is issued. For a Gift Membership, the Gift Recipient’s access begins when the gift is activated or redeemed in accordance with Section 6.

5.5. You shall ensure that the details you provide at Registration are accurate and kept up to date. You can change the details you provide at Registration at any time via the Website. If you would like us to cancel your Registration with our Service (which you may do so at any time) please see Section 13 below.

5.6. You are responsible for maintaining the confidentiality of your password and user name and are responsible for all activities that are carried out under them. 5.7. You can access your account at any time on the Website. You can update your account including your personal details via the Website.

6. GIFT MEMBERSHIPS

6.1. For the purposes of these Terms, the “Purchaser” is the person who purchases a Gift Membership, and the “Recipient” is the person for whom the Gift Membership is purchased and who redeems or uses it.

6.2. The provisions relating to payment, gift delivery, recipient information, cancellation before redemption and the purchase transaction apply to the Purchaser. The provisions relating to registration, account use, participation, Content, conduct and access apply to the Recipient. Some provisions may apply to both.

6.3. A Gift Membership is purchased for another person. The Purchaser does not receive access to the Service through that purchase unless they are separately registered under another valid membership.

6.1. Where a gift option is expressly offered on the Website, a person aged 18 or over may purchase a fixed-term membership for another person.

6.2. The Purchaser must be entitled to provide us with the intended Recipient’s details and must not provide another person’s details unlawfully or for an improper purpose. We will process those details in accordance with our Privacy Policy.

6.3. The Purchaser is responsible for checking the Recipient’s name and email address before completing the purchase. We are not responsible for a gift email or redemption information being delivered to an incorrect address supplied by the Purchaser, although we will use reasonable efforts to assist where we are contacted promptly.

6.4. A gift membership may be used only by its intended recipient. A gift code, redemption link or unactivated gift membership must not be resold, copied, published or exchanged for cash.

6.5. The Recipient must create their own personal account and agree to these Terms before accessing the Service. The Recipient must be aged 18 or over.

6.6. The Purchaser’s registration and payment do not activate the Recipient’s access. Access begins only when the Recipient follows the redemption process and completes their own registration.

6.7. A One-Year Gift Membership provides one year of access to the Content included in that membership at the time of purchase. It expires automatically at the end of that period and neither the Purchaser nor the Recipient will be charged again.

6.8. A One-Month Themed Gift Membership provides one month of access to the specific themed collection identified at the time of purchase. Access begins on activation or redemption and expires automatically one month later. It does not renew and does not include access to other themes or to the full Service unless expressly stated on the purchase page.

6.9. Content included in a themed collection will be described on the relevant purchase page. We may make reasonable substitutions or changes where Content becomes unavailable for legal, licensing or technical reasons, provided that the overall nature and value of the themed collection are not materially reduced.

6.10. A gift membership does not automatically convert into a paid recurring subscription when it expires. The Recipient may choose to purchase another membership separately.

6.11. Gift memberships must be redeemed within any redemption period stated on the purchase page or gift communication. Where no redemption deadline is stated, the gift may be redeemed for 12 months from the date of purchase. After that date, it may expire, subject always to the Purchaser’s and Recipient’s statutory rights.

6.12. Once redeemed, a gift membership is personal to the Recipient and cannot ordinarily be transferred to another person. We may agree to change an intended Recipient before redemption at our discretion where the Purchaser contacts us and provides satisfactory purchase information.

7. YOUR PROMISES TO US

8.2. We reserve the right to suspend, restrict or cancel your access to the Website and/or the Service at any time without notice if we have reasonable grounds to believe that you have breached any of the restrictions contained in these Terms. This suspension or cancellation (as applicable) shall be in accordance with Section 13.1 below. This shall not limit our right to take any other actions against you that we consider appropriate to defend our rights or those of any other person.

9. RIGHTS GRANTED AND RIGHTS RESERVED

9.1. These Terms apply to all users of and visitors to the Website and the Service. We reserve the right to discontinue any aspect of the Website and/or the Service at any time. If we discontinue the Service as a whole, the provisions of Section 13.2 shall apply.

9.2. The content on the Website, including without limitation, the Content, choreography, any movement sequences and creative works, and any text, software, scripts, graphics, photos, sounds, music, videos, interactive features and the like and the trademarks, service marks, logos, branding or any other intellectual property rights contained therein are owned by or licensed to us.

9.3. Save for your rights under Section 3.1 of these Terms, your use of the Website and/or the Service and their contents does not constitute any grant, assignment or transfer of rights to you in relation to our intellectual property rights including, without limitation, copyright, trademarks, choreography, logos, graphics, photographs, animations, videos and text or the intellectual property of third parties in the Website and/or the Service and their contents. You may not copy, share, perform, teach or exploit choreography outside this Service without our express written permission.

9.4. Any use other than that expressly permitted under these Terms may only be undertaken with our prior express authorisation.

9A. COPYRIGHT AND CHOREOGRAPHY RIGHTS

9A.1. All original choreography created for, featured in, or supplied through the Service (including but not limited to dance routines, performance movements, sequenced exercises and programme combinations) are protected by copyright and are the exclusive intellectual property of ChiChi Fit.

9A.2. Choreography is treated as a “dramatic work” under UK copyright law and is automatically protected without the need for registration. You agree that no rights are transferred to you in respect of choreography by virtue of your subscription, use of the Website or Service.

9A.3. You may only use the choreography provided via the Service for your personal, non-commercial use or as expressly permitted under these Terms. You may not use, reproduce, perform, publicly share, licence, sell, teach, distribute, adapt, broadcast, or otherwise exploit any choreography outside of the Service without our prior written permission.

9A.4. Posting full routines featuring ChiChi Fit choreography on social media, public platforms, or third-party websites is strictly prohibited. Excerpts may only be shared in accordance with any specific limitations published by us (for example, short clips for promotional purposes where permitted).

9A.5. Any infringement of our choreography rights may result in immediate termination of your access and may also expose you to legal liability.

10. LINKS TO AND FROM OTHER WEBSITES

10.1. We permit you to link to materials on the Website for personal, non-commercial purposes only and provided that you immediately stop providing such links if notified by us.

10.2. We may provide links to other websites from time to time (via advertising or otherwise). You acknowledge that these links are provided for your ease of reference and convenience only. We do not control such third-party websites and are not responsible for their contents. Our inclusion of links does not imply any endorsement of the material contained in such websites or any association with their operators. You acknowledge that we will not be party to any transaction or contract with a third party that you may enter into via such websites and we shall not be liable to you in respect of any loss or damage which you may suffer by using those websites. You agree that you will not involve us in any dispute between you and the third-party.

11. PROMOTIONS

11.1. We may offer free promotional periods for the Service from time to time, enabling new subscribers to subscribe to the Service without paying a subscription fee during the free promotional period (Free Period). Any Free Period which we may offer you shall be subject to these Terms. Any such offer of a Free Period shall be entirely at our discretion. Please note that unless otherwise stated, Free Period offers are only available to new subscribers and cannot be used in conjunction with any other promotion or offer (including any Promotional Code). If you have previously received a Free Period or other promotion, you may not be entitled to receive a further free promotional offer. Please contact us if you are not sure if you are entitled to a promotional offer or not.

You may cancel your subscription during the Free Period in accordance with Section 13 of these Terms. If you do not cancel before the end of the Free Period, you will be charged the price and at the billing frequency clearly displayed when you registered. Your subscription will then continue to renew at that frequency until cancelled.

11.2. Any use of a Promotional Code will be subject to these Terms and also the terms of the voucher/communication containing the Promotional Code.

12. CHARGES, PAYMENT AND RENEWAL

12.1 The price, billing frequency, access period, included Content and renewal arrangements for each membership option will be shown on the Website before you complete your purchase. Prices include VAT or other applicable sales taxes unless stated otherwise.

12.2 Monthly Subscription

The Monthly Subscription fee is charged in advance on the date of registration and will renew automatically each month on or around the same date using the payment method supplied, unless the subscription is cancelled in accordance with Section 13.

12.3 Annual Subscription

The Annual Subscription fee is charged in advance on the date of registration and provides access for one year. It will renew automatically for further one-year periods using the payment method supplied, unless the subscription is cancelled before the next renewal payment becomes due.

We will provide any renewal reminders required by applicable law and will clearly explain the renewal date, applicable price and method of cancellation.

12.4 One-Year Gift Membership

A One-Year Gift Membership is paid for in full by the purchaser at the time of purchase. It provides the recipient with one year of access beginning as described in Section 6. It is a fixed-term membership and does not renew automatically.

12.5 One-Month Themed Gift Membership

A One-Month Themed Gift Membership is paid for in full by the purchaser at the time of purchase. It provides the recipient with one month of access to the themed Content identified on the purchase page, beginning as described in Section 6. It is a fixed-term membership and does not renew automatically.

12.6 Price changes

Any change to our prices will not affect a membership period that has already been paid for. For a recurring Monthly or Annual Subscription, a changed price will apply no earlier than the next renewal date, and we will give any notice required by applicable law.

12.7 We are not obliged to honour a price that is clearly incorrect because of an obvious error. Where this occurs, we will contact the purchaser and offer the choice of paying the correct price or receiving a refund.

13. CANCELLATION, EXPIRY AND REFUNDS

13.1 Monthly and Annual Subscriptions

You may cancel the automatic renewal of a Monthly or Annual Subscription at any time through the My Account area of the Website or by using another cancellation method we make available.

13.2 Monthly Subscription cancellation

If you cancel a Monthly Subscription, you will normally retain access until the end of the monthly period for which you have already paid. No further monthly payment will then be taken.

13.3 Annual Subscription cancellation

If you cancel an Annual Subscription, you will normally retain access until the end of the annual period for which you have already paid. No further annual payment will then be taken.

Cancellation of automatic renewal does not ordinarily entitle you to a full or partial refund for an unused part of a period that has already been paid for, except where required by law or expressly agreed by us.

13.4 Gift memberships

One-Year Gift Memberships and One-Month Themed Gift Memberships are fixed-term products and do not need to be cancelled. They expire automatically at the end of their stated access period and no recurring payment will be taken.

13.5 Cancellation before redemption

A purchaser who wishes to cancel an unredeemed gift purchase should contact us promptly. Any right to cancel and receive a refund will be determined in accordance with applicable consumer law and these Terms.

13.6 Cancellation following redemption

Once a gift has been redeemed and immediate access to digital Content has begun, cancellation and refund rights may be affected. This does not limit any statutory rights that cannot legally be excluded, including rights where the Service is faulty, not as described or has not been supplied with reasonable care and skill.

13.7 Promotional periods

Where a free or discounted promotional period converts into a paid recurring subscription, the price, billing frequency and date of the first payment will be shown clearly before registration. If you cancel before the promotional period ends, access will continue until the stated expiry date and no recurring payment will be taken.

13.8 Statutory cancellation rights

Consumers may have a statutory right to change their mind within 14 days of entering into an online contract. Different rules may apply where digital Content or services begin during that period.

Where immediate access is requested, we will obtain any express consent and acknowledgement required by law. Nothing in these Terms excludes or restricts any statutory cancellation, refund or other consumer right that cannot legally be excluded.

14. SUSPENSION OR CANCELLATION BY US

14.1. If you breach any of the Terms we may immediately suspend your account and your access to the Service. If we reasonably believe that you have flagrantly or persistently breached any of these Terms we may cancel your subscription. If we cancel your use of the Service under this Section 14.1 such cancellation shall be immediate and without notice or refund.

14.2. In addition, we reserve the right to cancel our provision of the Service to you if we no longer provide the Service.

14.3 If we permanently discontinue the Service before the end of a paid membership period, or become unable to provide substantially all of a purchased themed collection, we will offer an appropriate remedy. Depending on the circumstances, this may include replacement Content, alternative access, an extension or a proportionate refund. This does not affect any remedy available under applicable law.

15. OUR LEGAL OBLIGATIONS AND LIMITS ON LIABILITY

15.1. We accept liability for death or personal injury caused by our negligence or that of our employees or agents. We do not seek to exclude liability for fraudulent misrepresentation by us or our employees or agents.

15.2. If we breach these Terms, we shall only be liable for losses which are a reasonably foreseeable consequence of such a breach, which means that they could be contemplated by you and us.

15.3. We make no guarantee that the Website or the Service will be provided uninterrupted.

15.4. We do not accept any liability for any losses, damage, costs or other liabilities incurred by you or for any loss of data from your computer system that results from:

(a) your negligence;

(b) your breach of these Terms; or

(c) anything which is beyond our reasonable control which prevents us from fulfilling our obligations under these Terms and includes, but is not limited to, fire, flood, storm, riot, industrial action, civil disturbance, war, nuclear accident, terrorist activity and acts of God.

15.5. Whilst we use all reasonable endeavours to correct any errors or omissions as soon as practicable once they have been brought to our attention, we do not promise that the information on the Website itself will be free from errors or omissions.

15.6. Access to the Website and/or the Service may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons reasonably beyond our control (as described in paragraph 15.4.(c)).

15.7. You have certain statutory rights. Nothing in these Terms is intended to affect your statutory rights. For more information about your statutory rights contact your local Citizens Advice Bureau, Trading Standards Office or Consumer Protection Office.

15.8 Subject to the liabilities that cannot legally be limited or excluded, our total liability arising out of or in connection with the Service will not exceed the total amount paid to us for the affected membership during the 12 months preceding the event giving rise to the claim.

Nothing in these Terms excludes or restricts your statutory rights or any liability that cannot lawfully be excluded or restricted.

16. PRIVACY

16.1. For more information on how we process your personal data and who we share it with, please read our Privacy Policy

16.2. We will comply with any applicable law or binding court order requiring or directing us to disclose the identity of and/or to locate anyone for the prevention or detection of crime or the apprehension or prosecution of offenders. There may be other circumstances in which we may be required by law to disclose information about you or your use of the Website and/or the Service.

17. CHANGES TO THESE TERMS

We may make reasonable changes to these Terms from time to time. Where a change is material, we will give you reasonable notice where required.

A change will not remove or materially reduce access that has already been paid for unless this is reasonably necessary for legal, regulatory, safety, technical or licensing reasons. If a material change significantly disadvantages you during a prepaid membership period, we will provide any remedy required by applicable law.

18. SEVERANCE

If any part of these Terms is disallowed or found to be ineffective by any court or regulator, the other provisions shall continue to apply.

19. TRANSFER

19.1 Memberships and accounts are personal and may not be transferred to another person, except where a gift membership is purchased through an authorised gift option offered by us.

Before redemption, we may permit the purchaser to nominate a different recipient in accordance with Section 6. After redemption, the membership and account are personal to the recipient and cannot ordinarily be transferred.

19.2. We may transfer our rights or obligations or sub-contract our obligations under these Terms to another legal entity. You agree that we may do so provided that the Website and/or the Service will be made available to you on the same terms or terms that are no less advantageous to you.

20. THIRD PARTY RIGHTS

These Terms are not intended to give rights to anyone except you and us. This does not affect our right to transfer our right or obligations or sub-contract our obligations under these Terms to another legal entity under Section 19.2.

21. DISPUTES

We will do our best to resolve any disputes in relation to these Terms. By using the Website and the Service you agree that the laws of England and Wales shall apply in relation to any disputes between us.

These Terms and Conditions were last updated on 15 July 2026.
